Court could soon rule to allow MOX termination to proceed
In its filing, the state admits that the MOX goose is cooked if the court rules again it: “Should the stay be granted and the preliminary injunction lifted, DOE will terminate the MOX Facility—the very action the State is challenging—and regardless of any future decision by the district court or this Court, the damage will be irrevocably done.” Abused taxpayers and fiscal conservatives can only hope that the MOX goose can never be uncooked once the court rules in this matter, whether now or in a few weeks.

Surprisingly, the state did not present any new arguments about possible harm it might suffer if MOX termination resumed. And, in spite of the judge’s raising questions about “standing” in the oral arguments of September 27 – see archived audio linked in September 28 news release to the left & here – the state offered no new thinking about why it has standing. Tactical mistake and fatal error?
