Picture South Carolina’s Last Stand (to Protect the MOX Debacle):

Hearing before federal court in Columbia, South Carolina on State of South Carolina’s weak case to stop termination of the MOX project, postponed until June 5, 2018 at 10:00 a.m.

Update from federal court, May 31: “NOTICE OF RESCHEDULED HEARING Motion Hearing set for 6/1/2018 10:00 AM in Columbia # 3, Matthew J. Posted in federal docket 1:18-cv-01431-JMC on May 29, 2018:  “TEXT ORDER: This matter is before the court on the State of South Carolina’s Motion for Expedited Briefing Schedule, Hearing and Ruling on Its Motion for Preliminary Injunction. (ECF No. 6.) On May 25, 2018, South Carolina filed a Complaint (ECF No. 1) and a Motion for Preliminary Injunction (ECF No. 5) seeking to prevent Defendants from terminating “the mixed oxide fuel fabrication facility project (MOX Project) currently under construction at the Savannah River Site (SRS) in Aiken County, South Carolina.” (ECF No. 6 at 2.) In the instant Motion, South Carolina asserts that it will suffer irreparable harm if Defendants are allowed to enter a full stop work and termination order on the MOX Project on June 11, 2018. Accordingly, South Carolina requests that the court “expedite the briefing schedule, the preliminary injunction hearing in this matter…, and issue a ruling on the State’s [Preliminary Injunction] Motion… no later than June 8, 2018.” (Id. at 3.) Upon consideration of South Carolina’s assertion of irreparable harm, the court GRANTS the Motion for Expedited Briefing Scheduling and Hearing. (ECF No. 6.) The court instructs Defendants to file any and all documentation in opposition to South Carolina’s Motion for Preliminary Injunction by 12 p.m. on Thursday, May 31, 2018. The court will conduct a hearing on the matter of South Carolina’s Motion for Preliminary Injunction on Friday, June 1, 2018, at 10 a.m. South Carolina shall file any reply in support of its Motion by Tuesday, June 5, 2018. South Carolina is instructed to serve on Defendants a copy of this Text Order, the Motion for Preliminary Injunction and Notice of the Preliminary Injunction Hearing on May 29, 2018, and file proof of such service on the court’s docket. If you have a copy of the National Nuclear Security Administration’s “partial stop work order” for the MOX debacle, thanks for sending it to us:  srswatch@gmail.com. The U.S. Nuclear Regulatory Commission has confirmed it in this response to SRS Watch of May 29, which could be an indication that we can expect something more permanent by August 13, 2018:  “On May 14, 2018, NNSA issued a partial stop work order for the project. This order was effective immediately and shall remain in effect for 90 days after the issuance of the letter, unless sooner canceled or otherwise dispositioned by the Government.”
